1. Definitions
• Hirer: The individual or entity hiring the portable bathroom(s) from Newcastle Portable Bathrooms.
• Hire Period: The duration for which the portable bathroom(s) are hired as specified in the booking agreement.
• Unit: Refers to the portable bathroom(s) being hired.
2. Agreement By placing an order for the hire of portable bathrooms, the Hirer agrees to be bound by these Terms and Conditions. If the Hirer does not agree to these terms, they should not proceed with the hire. The Hirer will be provided a rental agreement at time of booking. In the event the agreement is not signed, acceptance of the terms and conditions will be deemed granted upon receipt of the unit.
3. Booking and Payment
• All bookings must be made in advance and are subject to availability.
• A deposit of 50% of the total hire cost is required to confirm the booking.
• The remaining balance must be paid in full 7 days prior to the delivery date.
• Payment can be made via bank transfer or pay ID.
4. Cancellation Policy
• The Hirer may cancel their booking by providing written notice to Newcastle Portable Bathrooms.
• Cancellations made more than 14 days prior to the delivery date will receive a full refund of the deposit, minus a processing fee of
$40.
• Cancellations made less than 10 days prior to the delivery date will forfeit the deposit or the amount of 1 week hire at $880.00, which ever is greater, and may incur additional charges for cancellations made less than 5 days prior to the delivery date. See section Cancellation Policy for full details.
5. Delivery and Setup
• Newcastle Portable Bathrooms will deliver the portable bathrooms to the specified location on the agreed date and time.
• The Hirer is responsible for ensuring that the delivery site is accessible and suitable for the setup of the unit.
• Any additional costs incurred due to site inaccessibility may be charged to the Hirer.
6. Use of Portable Bathrooms
• The Hirer agrees to use the portable bathroom(s) in a manner consistent with their intended purpose.
• The Hirer is responsible for ensuring that the unit is not misused, damaged, or excessively soiled during the hire period.
• Any damages, excessive cleaning, or loss of the unit will be charged to the Hirer at the cost of repair or replacement.
7. Liability
• Newcastle Portable Bathrooms shall not be liable for any indirect, incidental, or consequential damages arising from the use of the portable bathrooms.
• The Hirer agrees to indemnify and hold Newcastle Portable Bathrooms harmless from any claims, damages, or losses arising from their use of the units.
8. Termination of Hire
• Newcastle Portable Bathrooms reserves the right to terminate the hire agreement if the Hirer fails to comply with these terms and conditions, including late payment or misuse of the unit.
• Upon termination, the Hirer must allow Newcastle Portable Bathrooms to collect the unit immediately.
9. Force Majeure
• Newcastle Portable Bathrooms shall not be held liable for any failure to deliver the portable bathrooms or any delays caused by circumstances beyond our control, including but not limited to natural disasters, strikes, or government restrictions
10. Governing Law
• These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia.
11. Amendments
• Newcastle Portable Bathrooms reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Hirer prior to the booking confirmation.
