1. Definitions
- "Company": Refers to Newcastle Portable Bathrooms.
- "Hirer": Refers to the individual(s) or entity hiring the portable bathroom(s) units from Newcastle Portable Bathrooms.
- "Unit": Refer to the portable bathroom units provided by the Company.
- "Hire Period": Refers to the duration for which the portable bathroom(s) are hired as specified in the booking agreement.
- "Agreement": Refers to the agreement between the Company and the Hirer.
2. Agreement
By placing an order for the hire of portable bathrooms, the Hirer acknowledges and agrees to be bound by these Terms and Conditions. If the Hirer does not accept these terms, they should refrain from proceeding with the hire. A rental agreement will be provided at time of booking. In the event that the rental agreement is not provided and/or not signed, acceptance of these Terms and Conditions will be considered granted upon the Hirers receipt of the unit or upon payment of the invoice, whichever occurs first.
3. Booking and Payment
3.1 Booking Requirements
- All bookings must be made in advance and are subject to availability.
3.2 Deposit
- To confirm the booking, a non-refundable deposit of 50% of the total hire cost is required.
3.3 Final Payment
- The remaining balance must be paid in full 7 days prior to the scheduled delivery date.
3.4 Payment Methods
- Payment can be made via bank transfer or pay ID.
3.5 Invoice Payment
- Invoices must be settled within the timeframe specified therein
3.6 Late Payment Policy
- . Late payments may incur additional charges of $10.00 per day until the total outstanding balance is paid in full.
4. Cancellation Policy
- The Hirer may cancel their booking by providing written notice to Newcastle Portable Bathrooms. Cancellations will result in the forfeiture of the deposit or an amount equivalent to one week's hire at a rate of $880.00, whichever is greater. See section Cancellation Procedures for further details.
5. Delivery and Setup
5.1 Delivery Schedule
- Newcastle Portable Bathrooms will deliver the portable bathroom units to the designated location on the agreed-upon date and time.
5.2 Site Accessibility
- The Hirer is responsible for ensuring that the delivery site is accessible and suitable for the setup of the unit.
5.3 Additional Costs
- Any additional costs incurred due to site inaccessibility or delays will be charged to the Hirer.
5.4 Communication of Site Requirements
- All site requirements must be communicated to Newcastle Portable Bathrooms prior to the delivery date to ensure a smooth setup process.
- Prior confirmation must be provided that all elements required for the operation of the bathroom units are located at the Hirers site and are within the specified proximity. This includes:
- An outdoor tap for water supply
- A sewer line, typically found in the front or backyard of residential properties, marked by a white cap covering the entry, or a septic tank for waste disposal.
- A 10A power outlet, to connect the unit to the electricity.
6. Key Responsibility
6.1 Provision of Keys
- Each hire includes two keys: one for accessing the unit and the other for the operations compartment.
6.2 Hirer's Responsibility
- The hirer assumes full responsibility for these keys once the unit has been delivered.
6.3 Charges for Lost or Unreturned Keys
- Lost or unreturned keys may incur charges for replacement, as well as potential downtime associated with the unit's operation.
7. Use of Portable Bathrooms
7.1 Intended Use
- The Hirer agrees to use the portable bathroom(s) in a manner consistent with their intended purpose.
7.2 Responsibility for Care
- The Hirer is responsible for ensuring that the unit is not misused, damaged, or excessively soiled during the hire period.
7.3 Charges for Damages and Cleaning
- Any damages, excessive cleaning, or loss of the unit will be charged to the Hirer at the cost of repair or replacement.
7.4 Condition Upon Return
- Units must be returned in a condition similar to their state upon delivery. Failure to do so will result in additional cleaning fees at a rate of $120.00 minimum, per hour.
8. Liability
8.1 Limitation of Liability
- Newcastle Portable Bathrooms shall not be liable for any indirect, incidental, or consequential damages arising from the use of the portable bathrooms.
8.2 Indemnification
- The Hirer agrees to indemnify and hold Newcastle Portable Bathrooms harmless from any claims, damages, or losses arising from their use of the units.
9. Termination of Hire
9.1 Right to Terminate
- Newcastle Portable Bathrooms reserves the right to terminate the hire agreement if the Hirer fails to comply with these terms and conditions, including but not limited to late payment or misuse of the unit.
9.2 Collection of Unit
- Upon termination, the Hirer must allow Newcastle Portable Bathrooms to collect the unit immediately.
10. Force Majeure
Newcastle Portable Bathrooms shall not be held liable for any failure to deliver the portable bathrooms or any delays caused by circumstances beyond our control, including but not limited to natural disasters, strikes, or government restrictions.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia.
12. Amendments
Newcastle Portable Bathrooms reserves the right to amend these Terms and Conditions at any time without prior notice.
